Terms of use and booking terms
Last updated 3 November 2026
These terms apply when you use Nearby Stays (the website at stays.nearbylocal.in) or book a stay through it. Nearby Stays is run by [Registered business name], [Registered address] (GSTIN [GSTIN number]) (“we”, “us”). By using the site or making a booking you agree to these terms, our Privacy Policy and our Cancellation & Refund Policy.
1. Who you’re booking with
Each stay is run by an independent host or property (the “host”), or by us where a listing says so. We list the stay, take your booking, collect payment on the host’s behalf and help you before and during your stay. The host provides the accommodation and is responsible for it, including its condition, safety and the house rules shown on the listing. Your contract for the stay is with the host; our role is that of a booking platform under the Consumer Protection (E-Commerce) Rules, 2020.
2. Using the site
- You must be at least 18 to make a booking, and the details you give (name, phone, email) must be accurate and yours.
- You can sign in with a one-time code sent to your phone or with Google. Keep access to them secure; you are responsible for bookings made from your account.
- Don’t misuse the site: no scraping, false bookings, attempts to access other people’s bookings, or interference with how it works.
3. How booking works
- The price you see for your dates is the total for the stay and includes applicable taxes. There are no booking fees.
- Unless a listing says “Instant confirmation”, your booking is a request: the host has 24 hours to confirm. It is only confirmed when we tell you so (on WhatsApp, by email or on your booking page). If the host can’t confirm, nothing is charged, or anything you paid is refunded in full.
- Listings with “Instant confirmation” are confirmed as soon as you book (and, where online payment is used, once payment succeeds).
- Each booking gets a reference starting with NLS-. Please quote it when you contact us.
4. Payment
- Prices are in Indian rupees (₹). If the site shows another currency, that is an estimate only; you are charged in rupees.
- We collect payment on behalf of the host, either through a UPI payment link after the host confirms, or online at checkout through our payment partner. We never see or store your card details or UPI PIN.
- Your stay is secured once payment is received. If payment isn’t made within the time we tell you, the booking may be released.
- A tax invoice or receipt is issued for each paid booking.
5. Cancellations, changes and refunds
Each room shows its cancellation terms before you book, and they form part of your booking. Our Cancellation & Refund Policy explains how cancellations, date changes, no-shows and refunds work.
6. During your stay
- Carry a valid government photo ID for every adult. Foreign nationals must show their passport and visa, which hosts are required to report to the authorities.
- Follow the house rules on the listing and the host’s reasonable instructions. Check-in and check-out times are shown on the listing.
- You are responsible for any damage you or your guests cause beyond normal wear and tear. A host may refuse check-in or end a stay for serious breaches of the rules, unsafe behaviour or illegal activity, without a refund.
- If something is wrong with your stay, tell us on WhatsApp straight away so we can help put it right while you’re there.
7. Our responsibility
We take care to describe stays accurately and only list places we run or have visited. The host is responsible for the accommodation itself. To the extent the law allows, we are not liable for indirect or consequential loss, or for events outside our reasonable control (such as natural disasters, government orders or strikes). Where we are liable, our liability is limited to the amount you paid for the booking concerned. Nothing in these terms limits your rights as a consumer under Indian law.
8. Content and reviews
The site’s text, photos and design belong to us or our hosts and may not be copied without permission. Reviews we show are from real guests (with their source noted, for example Airbnb). If you send us a review, you allow us to show it with your first name.
9. Messages we send
We’ll contact you on WhatsApp, SMS or email about your booking (confirmations, payment links, check-in details, changes). We only send offers if you agree to receive them, and you can opt out at any time.
10. Complaints and grievance officer
For any problem, message us on WhatsApp at +91 96505 95027 or email [support email]. You can also write to our Grievance Officer, [Grievance officer name], at [grievance email] or [Registered address]. We acknowledge complaints within 48 hours and aim to resolve them within one month of receipt.
11. Law and disputes
These terms are governed by the laws of India. We’ll always try to settle a disagreement with you directly first. Subject to your rights to approach a consumer commission, the courts at [City] have jurisdiction.
12. Changes to these terms
We may update these terms from time to time; the date at the top shows the latest version. The terms in force when you booked apply to that booking.
